Terms of Service
These Terms of Service (“Terms”) form a binding agreement between you (“you”, “the User”) and Aloïs Canot, a sole developer established in France (“we”, “us”, “the Developer”), governing your use of the Sentinel macOS menu bar application, the Sentinel iOS companion application, the Sentinel watchOS extension, and the associated backend services (collectively, “Sentinel” or “the Service”).
Please read these Terms carefully. By installing, accessing, or using Sentinel, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use Sentinel.
1. Definitions
- “App” means any of the Sentinel applications for macOS, iOS, or watchOS.
- “Backend” means the server-side services operated by the Developer on Cloudflare Workers and D1 to support Sentinel.
- “Account” means your personal registered account used to authenticate with the Service.
- “Pro” means the paid tier of Sentinel, offered as an auto-renewing subscription or as a one-time lifetime purchase.
- “Free Tier” means the non-paid tier of Sentinel, providing basic motion detection and alerts.
- “Content” means any data, media, photos, screenshots, events, or other material generated by or transmitted through the Service.
2. Eligibility
To use Sentinel, you must:
- be at least 13 years old (and at least the minimum age of digital consent required in your country of residence);
- have the legal capacity to enter into a binding contract; and
- not be barred from using the Service under applicable law or Apple’s terms.
If you use Sentinel on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Account Registration
You may be required to create an Account using your email address or Sign in with Apple. You are responsible for:
- providing accurate information;
- keeping your credentials confidential;
- all activity occurring under your Account.
You must notify us promptly at alois@canot.dev of any unauthorized use of your Account.
4. License Grant
Subject to your compliance with these Terms, the Developer grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use Sentinel on devices you own or control, for your own personal, non-commercial use.
The iOS and watchOS apps are licensed (not sold) to you under the terms of Apple’s Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula, which is incorporated by reference and applies to those apps in addition to these Terms. In the event of a conflict regarding the iOS or watchOS apps, Apple’s EULA prevails.
The macOS app is distributed directly by the Developer as a DMG and is licensed on the same personal, limited basis described above.
5. Restrictions
You agree not to:
- use Sentinel for any unlawful purpose, or in violation of the rights or privacy of others (for example, to surveil a person who has not given informed consent on a device they control);
- copy, modify, translate, adapt, decompile, reverse engineer, or create derivative works of Sentinel, except to the extent such restriction is prohibited by applicable law;
- rent, lease, lend, sell, redistribute, or sublicense Sentinel;
- remove or alter any copyright, trademark, or other proprietary notices;
- attempt to gain unauthorized access to the Backend, other users’ accounts, or any related systems or networks;
- use Sentinel to transmit malware, spam, or other harmful content;
- use Sentinel in a way that could damage, disable, overburden, or impair the Service;
- circumvent usage limits, security controls, or entitlement checks;
- use automated scripts or bots to interact with the Backend except as expressly permitted.
6. Intended Use and User Responsibility
Sentinel is designed to help you detect and respond to suspicious activity on your personal devices. You acknowledge that:
- Sentinel is a supplementary security tool, not a guaranteed anti-theft system, security service, or emergency response service.
- Detection relies on sensors, network connectivity, and services (including Apple’s APNs) that may be unavailable, delayed, or inaccurate for reasons outside our control.
- You are responsible for configuring Sentinel appropriately for your environment, including enabling camera capture, screenshot capture, and location features only where lawful.
- In the event of a suspected theft or emergency, you are responsible for contacting law enforcement or the appropriate authorities. We do not contact authorities on your behalf.
- You must have the legal right to install Sentinel on each device you configure and to capture photos, screenshots, and location from that device.
7. Subscriptions, Payments, and Auto-Renewal
7.1 Pricing tiers
Sentinel is offered with a Free Tier and a Pro Tier. Pro is available as either:
- a monthly auto-renewing subscription;
- a yearly auto-renewing subscription; or
- a lifetime one-time purchase.
Current prices are displayed in the iOS app at the time of purchase and may vary by territory and currency.
7.2 How purchases are processed
All purchases and subscriptions are processed by Apple through StoreKit and charged to your Apple ID at confirmation of purchase. We do not receive or store your payment card information.
7.3 Auto-renewal
Auto-renewing subscriptions renew automatically at the end of each billing cycle at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
7.4 Managing and cancelling subscriptions
You may manage or cancel your subscription at any time in your Apple ID settings on your iPhone, iPad, or Mac (Settings > [your name] > Subscriptions). Deleting the app does not cancel the subscription. Cancellation takes effect at the end of the current paid period.
7.5 Free trials
If a free trial is offered and you do not cancel at least 24 hours before the trial ends, the subscription will begin automatically at the applicable price. Any unused portion of a free trial is forfeited when you purchase a subscription, to the extent permitted by Apple’s rules.
7.6 Price changes
We may change prices from time to time. If a price change affects your active auto-renewing subscription, Apple will notify you and, where required, obtain your consent before the change takes effect.
8. Refunds
Purchases made through the App Store are subject to Apple’s refund policy. Refund requests must be submitted to Apple via reportaproblem.apple.com. We do not directly process refunds for App Store transactions.
For users in the European Union, you acknowledge that the Pro subscription is a digital service that begins immediately upon purchase with your express prior consent, and you therefore waive the statutory 14-day right of withdrawal to the extent permitted by applicable law.
Where mandatory consumer protection laws grant you additional rights (for example, refunds for defective digital services), those rights remain unaffected by these Terms.
9. Updates
We may release updates to Sentinel to add features, fix bugs, or improve security. Updates may be delivered automatically through the App Store or manually for the macOS app. Some updates may be required for the Service to continue working; if you decline a required update, you may lose access to some or all features.
10. Intellectual Property
Sentinel, including all software, designs, logos, text, graphics, and other content, is the property of the Developer or its licensors, and is protected by French and international intellectual property laws. Nothing in these Terms grants you any right in Sentinel except the limited license expressly set out in Section 4.
“Sentinel” and associated logos are trademarks of the Developer. You may not use them without prior written permission.
11. Your Content
You retain all rights in the photos, screenshots, and event data captured by Sentinel. By using the Service, you grant the Developer a limited, worldwide, royalty-free license to transmit, process, and temporarily store that Content solely for the purpose of operating the Service (for example, delivering alerts to your iPhone). This license ends when the Content is purged from our systems in accordance with our Privacy Policy.
You are solely responsible for your Content and for ensuring it complies with applicable law.
12. Privacy
Your use of Sentinel is also governed by our Privacy Policy. The Privacy Policy explains what data we collect, how we use it, and your rights under the GDPR and other applicable laws.
13. Termination
13.1 Termination by you
You may stop using Sentinel at any time. You may delete your Account from within the iOS app, which will trigger deletion of your personal data in accordance with the Privacy Policy. Cancelling a subscription is separately managed through your Apple ID settings.
13.2 Termination by us
We may suspend or terminate your access to the Service, with or without notice, if:
- you materially breach these Terms;
- we are required to do so by law;
- continued provision of the Service to you would expose us or other users to legal, security, or operational risk;
- we discontinue the Service in whole or in part.
Where termination is not due to your breach, and you have paid for an unused period of a subscription, you may be entitled to a pro-rata refund of amounts paid, subject to Apple’s refund policy.
13.3 Effect of termination
Upon termination, your right to use Sentinel ceases immediately. Sections that by their nature should survive termination (including Sections 5, 10, 14, 15, 16, and 17) will continue to apply.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Sentinel is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or availability.
Without limiting the foregoing, we do not warrant that:
- the Service will be uninterrupted, timely, secure, or error-free;
- detection, capture, or notification will be accurate, complete, or successful in preventing theft, loss, damage, or unauthorized use;
- defects will be corrected; or
- the Service will be compatible with any specific hardware or software configuration.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.
15. Limitation of Liability
To the maximum extent permitted by applicable law:
- the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of devices, loss of profits, business interruption, or cost of substitute services, arising out of or in connection with your use of Sentinel;
- the Developer’s total cumulative liability arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to Apple for Sentinel in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty euros (€50).
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, wilful misconduct, or personal injury caused by our negligence.
16. Indemnity
You agree to indemnify and hold harmless the Developer from and against any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or connected to:
- your breach of these Terms;
- your misuse of Sentinel (including unlawful surveillance of third parties); or
- your violation of any law or of the rights of any third party.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of France, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of France, subject to any mandatory consumer protection rules that grant consumers the right to bring proceedings in the courts of their country of residence.
Consumers in the European Union may also use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.
18. Third-Party Terms
Your use of Sentinel on Apple platforms is subject to Apple’s applicable terms, including:
- the Apple Media Services Terms and Conditions (for App Store purchases);
- the Licensed Application End User License Agreement;
- Apple’s privacy and platform policies.
You acknowledge that Apple is a third-party beneficiary of these Terms with respect to the iOS and watchOS apps, and that Apple has the right (but not the obligation) to enforce these Terms against you as such third-party beneficiary.
Apple is not responsible for Sentinel or for addressing any claims relating to Sentinel, including product liability claims, consumer-protection claims, or claims that Sentinel fails to conform to any applicable legal or regulatory requirement.
19. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Service, in applicable law, or in our operations. When we do, we will update the “Last updated” date above and, where the changes are material, notify you by email or through the app. Your continued use of Sentinel after a change takes effect constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using Sentinel.
20. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any in-app disclosures, constitute the entire agreement between you and the Developer regarding Sentinel.
- Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
- Force majeure. The Developer shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, war, terrorism, strikes, outages of third-party services, or government action.
